(Scope of Application)

Article 1.
  1. Accommodation contracts and related agreements entered into between this hotel and its guests shall be governed by the provisions of these Terms and Conditions. Matters not specified herein shall be governed by applicable laws and regulations or generally established customs.
  2. Where the Hotel agrees to special terms not contrary to laws, regulations, or established customs, such special terms shall prevail over the provisions of the preceding paragraph.

(Application for Accommodation Contract)

Article 2.
  1. Persons wishing to apply for an accommodation contract at this hotel shall provide the following information to the hotel.
    1. The guest’s name, registered address, and telephone number (or mobile phone number)
    2. The dates of stay and estimated arrival time
    3. The accommodation charges (in principle, based on the basic accommodation rates in Schedule 1)
    4. Any other information deemed necessary by the Hotel
  2. If a guest requests to extend their stay beyond the date specified in Item (2) of the preceding paragraph during their stay, the hotel shall treat this request as a new application for an accommodation contract at the time it is made.
  3. Personal information obtained by the hotel will be used in accordance with the “Handling of Personal Information” policy.

(Establishment of Accommodation Contract, etc.)

Article 3.
  1. The lodging contract shall be deemed concluded when the Hotel accepts the application described in the preceding Article. However, this shall not apply if the Hotel proves it did not accept the application.
  2. When the lodging contract is concluded pursuant to the preceding paragraph, the guest shall pay the application fee specified by the Hotel as the basic lodging fee for the lodging period by the date designated by the Hotel.
  3. The application fee shall first be applied toward the final accommodation charges payable by the guest. Should circumstances arise where the provisions of Article 6 and Article 18 apply, the fee shall be applied in the order of liquidated damages followed by compensation. Any remaining balance shall be refunded upon payment of charges pursuant to Article 12.
  4. If the application fee specified in Paragraph 2 is not paid by the date designated by the hotel pursuant to the provisions of that paragraph, the lodging contract shall lose its effect. However, this shall only apply if the hotel has notified the guest of the designated payment date for the application fee.

(Special provision waiving the application fee)

Article 4.
  1. Notwithstanding the provisions of Paragraph 2 of the preceding Article, the Hotel may agree to a special arrangement whereby payment of the application fee specified in said paragraph is not required after the contract is concluded.
  2. If the Hotel does not request payment of the application fee under Paragraph 2 of the preceding Article when accepting an application for an accommodation contract, or if it does not specify a payment date for said application fee, it shall be treated as having agreed to the special provision under the preceding paragraph.

(Refusal to Enter into an Accommodation Contract)

Article 5.
The Hotel may refuse to enter into an accommodation contract in the following cases:
  1. When the accommodation request does not comply with these Terms and Conditions;
  2. When the Hotel is fully booked and no rooms are available;
  3. When the person seeking lodging is deemed likely to engage in conduct regarding lodging that violates laws and regulations, public order, or public morals.
  4. When the person seeking lodging is deemed likely to disrupt the peaceful operation of the hotel, such as by using violent words or actions toward hotel employees or other guests, detaining hotel employees for extended periods, or engaging in conduct that interferes with the duties of hotel employees.
  5. When any of the following circumstances apply to the person seeking lodging:
    1. Persons designated as organized crime groups or members thereof under the Act on Prevention of Unjust Acts by Organized Crime Group Members (Act No. 77 of 1991), persons associated with such groups, or other antisocial forces (hereinafter referred to as organized crime groups, etc.)
    2. Corporations, other organizations, or their members controlled by organized crime groups in their business activities
    3. Corporations where individuals falling under organized crime groups serve as officers, or their members
  6. When a person seeking lodging is clearly recognized as having an infectious disease
  7. When violent demands are made by a person seeking lodging, or when excessive demands such as the following are made
    1. Provision of services not offered by this hotel
    2. Provision of services violating laws, regulations, or public order and morals
    3. Demands for post-contract discounts without justifiable reason
    4. Demands for room upgrades, provision of meals not included in the contract, or other services without justifiable reason
    5. Other burdens exceeding reasonable limits
  8. When verbal abuse, assault, threats, extortion, or fraudulent acts are committed against hotel employees or other guests
  9. When malicious posts containing false information or defamation against hotel employees or other guests are made on SNS, message boards, etc.
  10. When accommodation cannot be provided due to natural disasters, facility malfunctions, or other unavoidable circumstances
  11. When a prospective guest is deemed likely to cause significant disturbance to other guests due to intoxication, etc., or when a guest engages in behavior causing significant disturbance to other guests. (Based on prefectural ordinances)
  12. When a prospective guest has had prior disputes with this hotel

(Guest’s Right to Cancel the Contract)

Article 6.
  1. A guest may cancel the lodging contract by notifying the hotel.
  2. Should a guest cancel all or part of the lodging contract for reasons attributable to the guest (excluding cases where the hotel specified a payment deadline for the reservation deposit under Article 3, Paragraph 2 and requested payment, and the guest cancels the contract before making such payment), the hotel shall charge a cancellation fee as set forth in Schedule 2. However, this shall only apply if the hotel has agreed to the special terms under Article 4, Paragraph 1, and has notified the guest of the obligation to pay the penalty fee in the event of cancellation when agreeing to those special terms.
  3. If a guest fails to arrive by 8:00 PM on the scheduled arrival date (or two hours after the specified arrival time, if one was provided in advance) without contacting the hotel, the hotel may treat the accommodation contract as having been canceled by the guest.

(The Hotel’s Right to Terminate the Contract)

Article 7.
  1. The Hotel reserves the right to refuse service at any time if it becomes known after a reservation is made or during the stay that any of the following applies:
    1. The guest is deemed likely to engage in conduct that violates laws and regulations, requests from public authorities, public order, or public morals concerning their stay, or is deemed to have engaged in such conduct;
    2. When a guest is deemed likely to disrupt the peaceful order within the hotel by, for example, using abusive language or violence toward hotel employees, detaining hotel employees for an extended period, or engaging in acts that interfere with hotel employees’ duties.
    3. When any of the following circumstances apply to the person applying for the accommodation agreement and related contracts or to any person using the hotel:
      ① When the person is a member of an organized crime group, an associate thereof, or otherwise falls under the category of organized crime groups.
      ② When the person is a member of a corporation or other organization controlled by organized crime groups for business activities, or a member thereof.
      ③ When the person is a member of a corporation where an individual falling under the category of organized crime groups serves as an officer, or a member thereof.
      ④ When a guest has engaged in conduct causing significant disturbance to other guests.
    4. When a guest is clearly recognized as having an infectious disease.
    5. When violent demands are made regarding the accommodation, or when burdens exceeding reasonable limits are requested. This includes instances where similar behavior has occurred previously.
      ① Demands for services not provided by this hotel.
      ② Provision of services violating laws, regulations, or public order and morals
      ③ Demands for post-contract discounts without justifiable reason
      ④ Demands for room upgrades, provision of meals not included in the contract, etc., without justifiable reason
      ⑤ Threats, extortion, or fraudulent acts against hotel employees
      ⑥Malicious posts on SNS, message boards, etc., containing false information or defamation/slander against hotel employees
      ⑦ When a guest makes intimidating or unreasonable demands and requests that go beyond a reasonable scope; or when it is determined that the guest has engaged in similar conduct at this hotel in the past.
      ⑧ When acts similar to those listed in ① through ⑦ occur.
    6. When accommodation cannot be provided due to reasons attributable to force majeure such as natural disasters.
    7. When a person seeking accommodation is severely intoxicated or otherwise likely to cause significant disturbance to other guests, or when they engage in conduct that significantly disturbs other guests (based on prefectural ordinances).
    8. When a guest smokes in bed in a guest room, tampers with firefighting equipment, or otherwise fails to comply with prohibited acts specified in the hotel’s usage rules
  2. When the hotel cancels the lodging contract based on the provisions of the preceding paragraph, the hotel shall not charge the guest for lodging services or other services not yet provided.

(Accommodation Registration)

Article 8.
  1. Guests shall register the following information at the hotel front desk on the day of their stay.
    1. Guest’s name, age, gender, address, telephone number (or mobile phone number), and occupation
    2. For foreign nationals: nationality, passport number, port of entry, and date of entry
    3. For foreign nationals without a Japanese address: in addition to the preceding item, a copy of the passport
    4. Departure date and scheduled departure time
    5. Names of accompanying persons
    6. Other items approved by the hotel
  2. When a guest intends to pay the charges under Article 12 using methods substitutable for currency, such as traveler’s checks, lodging vouchers, or credit cards, they must present these at the time of registration specified in the preceding paragraph.

(Guest Room Usage Hours)

Article 9.
  1. Guests may use their hotel rooms from 3:00 PM until 11:00 AM the following morning. However, for consecutive stays, rooms may be used throughout the day, excluding the arrival and departure dates. Please note that even after the check-in start time, guests may occasionally be required to wait due to room preparation or other unavoidable circumstances.
  2. Notwithstanding the preceding paragraph, the hotel may permit use of guest rooms outside the hours specified therein. In such cases, the following additional charges shall apply:
    1. For up to 3 hours overstay: 30% of the room rate
    2. For up to 6 hours overstay: 50% of the room rate
    3. For over 6 hours: 100% of the room rate
      Please note that we may decline requests when the hotel is fully booked.

(Compliance with Terms of Use)

Article 10.
Guests shall comply with the Terms and Conditions of Stay h established by the hotel and the usage rules posted within the hotel premises while staying at this hotel.

(Business Hours)

Article 11.
  1. The operating hours for the hotel’s main facilities are as follows. Detailed operating hours for other facilities will be posted at each location.
    1. Front Desk, Cashier, and Other Service Hours:
      • Front Desk Service: 24 hours
      • Guest Lounge: 24 hours
      • Parking Lot: 7:00 AM – 11:00 PM
      • Coin Laundry: 24 hours
      • Vending Machine Area: 24 hours
    2. Food & Beverage (Facility) Service Hours:
      • Breakfast (4F): 7:00 AM – 10:00 AM (Last order 9:30 AM)
      • Other Food & Beverage Services: Hours will be posted at various locations within the hotel.
  2. The hours listed in the preceding section may be temporarily changed when necessary and unavoidable. In such cases, notification will be provided by appropriate means.

(Payment of Fees)

Article 12.
  1. The breakdown of lodging fees and other charges payable by guests shall be as set forth in Schedule 1.
  2. Payment of the lodging fees and other charges specified in the preceding paragraph shall be made at the front desk upon the guest’s arrival or when requested by the hotel, using currency or methods acceptable to the hotel, such as traveler’s checks, lodging vouchers, credit cards, or other equivalent means.
  3. Even if a guest voluntarily chooses not to stay after the hotel has provided a guest room and made it available for use, lodging fees shall be charged.

(Responsibility of the Hotel)

Article 13.
  1. The Hotel shall compensate guests for damages incurred in the performance of the lodging contract and related contracts, or due to the non-performance thereof. However, this shall not apply if such damages are not attributable to causes for which the Hotel is responsible.
  2. The Hotel maintains lodging liability insurance to address unforeseen events such as fire.

(Handling When Contracted Rooms Cannot Be Provided)

Article 14.
  1. Should the hotel be unable to provide the contracted guest room to a guest, it shall, with the guest’s consent, arrange alternative lodging at another facility under conditions as similar as possible.
  2. Notwithstanding the preceding paragraph, if the Hotel is unable to arrange alternative lodging, it shall pay the guest compensation equivalent to the penalty fee, which shall be applied toward damages. However, no compensation shall be paid if the inability to provide the room is not attributable to the Hotel.

(Handling of Deposited Items, etc.)

Article 15.
  1. Should any loss, damage, or destruction occur to items, cash, or valuables deposited by a guest at the front desk, the Hotel shall compensate for such damage, except in cases of force majeure. However, for cash and valuables, if the guest did not previously declare the type and value, the Hotel shall compensate for damages up to 150,000, unless the Hotel acted with intent or gross negligence.
  2. The hotel shall compensate for any loss, damage, or destruction of items, cash, or valuables brought into the hotel by a guest but not deposited at the front desk, provided such loss, damage, or destruction results from the hotel’s intentional act or negligence. However, for items whose type and value were not declared in advance by the guest, the Hotel shall compensate for damages up to a maximum of 150,000, unless such damages result from the Hotel’s intentional act or gross negligence.
  3. The Hotel cannot accept custody of artworks, antiques, musical instruments, or similar items.

(Storage of Guests’ Luggage or Personal Belongings)

Article 16.
  1. If a guest’s luggage arrives at the hotel prior to their check-in, the hotel shall store it responsibly only if the hotel has given its consent before the luggage’s arrival. The luggage shall be handed over to the guest at the front desk upon check-in.
  2. If luggage or personal belongings are left behind at the hotel after a guest has checked out, the hotel will, in principle, await contact from the owner inquiring about the items and seek their instructions. If no instructions are received from the owner, valuables will be reported to the nearest police station within 7 days including the discovery date. Other items will be disposed of after 3 months. However, food and beverages, tobacco, magazines, items likely to compromise sanitary conditions, and other items equivalent to waste (such as clearly broken items) will be discarded the following day, even within the storage period.
  3. The Hotel’s liability for storing guests’ luggage or personal belongings in the cases described in the preceding two paragraphs shall be governed by the provisions of the preceding article, paragraph 1 for cases under paragraph 1, and by the provisions of the same article, paragraph 2 for cases under the preceding paragraph.
  4. The Hotel may inspect the contents of any left-behind luggage or personal belongings at its discretion to determine appropriate handling based on the nature of the contents.
  5. Should costs be incurred in returning found items to their owner at the hotel, the owner shall bear such costs.
  6. If items requiring disposal costs, such as bulky waste, are intentionally or negligently left by a guest in a guest room, common area, or other premises of the hotel, the hotel shall charge a reasonable amount as an agency fee in addition to the disposal costs incurred in accordance with laws and regulations. Furthermore, if it can be objectively inferred that the item was intentionally abandoned, or if no contact regarding the personal belongings is made within one week after the checkout date, the item will be treated as intentionally abandoned and ownership forfeited.

(Responsibility for Parking)

Article 17.
When guests use the hotel’s parking lot, regardless of whether vehicle keys are deposited, the hotel provides the space but assumes no responsibility whatsoever for the management of vehicles. However, if damage is caused due to the hotel’s intentional act or negligence in managing the parking lot, the hotel shall be liable for compensation.

(Guest Responsibility)

Article 18.
If the Hotel suffers damage due to the intentional or negligent acts of a guest, such guest shall compensate the Hotel for the damage incurred.

  1. In the event of amendments to tax laws, the amended provisions shall apply.

(Note)

  1. The percentage indicates the ratio of the cancellation fee to the base accommodation charge.
  2. If the contracted number of days is shortened, a cancellation fee equivalent to one day (the first day) will be charged regardless of the number of days shortened.
  3. For specific dates designated by the hotel, additional cancellation fees may apply.

(Refusal to Enter into Service Contracts Other Than Accommodation)

Article 19.
The Hotel may refuse to enter into a contract for services other than lodging in the following cases:
  1. When any of the following applies to the person applying for the service contract or to any person using the Hotel:
    1. The person falls under the category of organized crime groups, etc., as defined in Article 5, Paragraph 5.
    2. The person is judged likely to engage in acts that violate laws and regulations, requests from government agencies, or public order and morals.
  2. When the person has engaged in words or actions that cause significant inconvenience to other guests of the Hotel.
  3. When unreasonable demands are made upon the hotel or its employees, exceeding a reasonable scope, such as:
    1. Providing services not offered by the hotel
    2. Providing services that violate laws, regulations, or public order and morals
    3. Demanding discounts without justifiable reason
    4. Coercion regarding matters without justifiable reason, or demands for services not included in the contract
    5. When verbal abuse, physical assault, delay tactics (prolonged detention), threats, extortion, or fraudulent acts are directed at hotel employees
    6. When malicious posts containing false information or defamation of hotel employees are made on SNS, message boards, etc.
    7. When making intimidating, unreasonable demands that impose an excessive burden beyond reasonable limits. Or when it is determined that similar behavior has previously occurred at any group hotel. (If such facts are discovered after reservation or during your stay, we will refuse service at that time.)
  4. When violating the hotel’s usage rules. (Including when the hotel determines there is a risk of violation.)
  5. When the hotel reasonably determines that the guest’s use of the hotel is unacceptable.

(Governing Law and Jurisdiction)

Article 20.
  1. Any dispute arising from the accommodation contract between the Hotel and the guest shall be governed by Japanese law. The Tokyo District Court or the Tokyo Summary Court shall be the agreed court of first instance.

(Amendment to the Accommodation Terms and Conditions)

Article 21.
  1. The Hotel may, at its discretion, amend the Accommodation Terms and Conditions in the following cases:
    1. When the change to the Accommodation Terms and Conditions is in the general interest of guests.
    2. When the change to the Accommodation Terms and Conditions does not conflict with the purpose of the Accommodation Contract and is reasonable in light of the necessity for the change, the appropriateness of the revised content, the details of the change, and other circumstances related to the change.
  2. When amending the Accommodation Terms and Conditions pursuant to the preceding paragraph, the hotel shall post the following on its website and other designated locations at least two weeks prior to the effective date of the amended terms: the fact that the terms are being amended, the content of the amended terms, and their effective date.

(Internet Communication)

Article 22.
  1. Use of the Internet communication services within the hotel shall be at the guest’s own risk. Services may be interrupted or terminated without prior notice due to system failures or other reasons.
  2. The hotel shall not be liable for any damages incurred by guests as a result of service interruptions due to system failures or other reasons during internet communication use, except in cases of intentional misconduct or gross negligence on the part of the hotel. Should the hotel deem any guest’s internet communication usage inappropriate and anticipate or experience actual damages to the hotel or third parties as a result, the hotel may request termination of such service usage and shall be entitled to compensation for any damages incurred.

(Other)

Article 23.
  1. In accordance with the Fire Service Act, fire alarms are installed throughout the hotel. Should an alarm be triggered due to fire or other reasons, an announcement may be broadcast throughout the premises. The hotel shall not be held liable for any damages incurred by guests as a result of such announcements.
  2. For the safety of our guests, even if a Do Not Disturb h card is displayed on a guest room door, hotel staff may attempt to contact the guest by telephone or by calling at the door if there has been no contact for an extended period. Furthermore, please understand that if there is no response or in an emergency, or if the hotel deems it necessary, staff may enter the guest room without prior notice.
  3. Unauthorized photography, videography, or recording using any equipment (including cameras, video cameras, DVDs, etc.) for commercial purposes within guest rooms or on hotel premises is strictly prohibited. Furthermore, even if privately recorded, posting such material online for commercial purposes or distributing it via social media (including live streaming) without the hotel’s permission is prohibited. Violations may result in legal action.
  4. We do not permit visitors (including companions) other than registered guests (as defined in Article 2 of the Accommodation Terms) to enter guest rooms or stay overnight.
  5. If the hotel accepts delivery of items addressed to a guest, the hotel shall not be liable for any loss, damage, or other issues with such items unless caused by reasons attributable to the hotel.
  6. We do not permit the use of the hotel’s address for residence registration purposes. Proof of stay will be provided by issuing a Certificate of Lodging h; we do not issue Certificates of Residence.
